Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and the ForestVPN operating company located at #27, 36-38, Takaishvili st., Batumi, Georgia, 6004 ("ForestVPN", "we", "us", or "our"), and they govern your use of the ForestVPN service. Please read them carefully. By creating an account, installing one of our apps, or otherwise using the Service, you agree to these Terms.

1. Acceptance of these terms

By creating a ForestVPN account, installing one of our apps, or otherwise using the ForestVPN service (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization — for example as a white-label business customer ("Tenant") — you represent that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.

2. The Service

ForestVPN provides a virtual private network and related privacy tooling that encrypts your network traffic and routes it through our servers, operated as a no-logs service (see our Privacy Policy). The VPN uses a modern WireGuard-style protocol with a relay fallback when a direct path is unavailable.

ForestVPN is also a white-label VPN platform. The platform serves two audiences:

  • Consumers — individual end users of the ForestVPN consumer app, or of a Tenant's branded product, who use the VPN for personal privacy. If you reached the Service through a Tenant's branded product, that Tenant owns the customer relationship and may apply its own additional terms; these Terms govern the underlying ForestVPN Service.
  • Tenants — businesses that run their own branded VPN product on the ForestVPN platform. A Tenant administers its own projects, end users, plans, and billing through the platform console. Where a Tenant processes the personal data of its end users, the Tenant is the data controller and ForestVPN is its processor under the Data Processing Agreement.

We continuously improve the Service and may add, change, or remove features over time. We aim to give reasonable notice of material changes that reduce core functionality.

3. Your account

You are responsible for the activity that happens under your account and for keeping your credentials secure. You must provide accurate information when you register and keep it up to date. You may sign in with an email address or through a supported third-party identity provider (such as Apple, Google, or, for business customers, your organization's single sign-on). Notify us promptly at [email protected] if you believe your account has been compromised. You must be old enough to form a binding contract in your jurisdiction (and at least the age of digital consent where that applies) to use the Service.

4. Acceptable use

You agree not to use the Service to:

  • break any applicable law or regulation, or facilitate someone else doing so, including using the Service for any unlawful, fraudulent, or harmful purpose;
  • send spam, distribute malware, or otherwise abuse, attack, overload, or interfere with any network or system, including ours;
  • infringe the intellectual-property, privacy, or other rights of others;
  • transmit material that is unlawful, defamatory, harassing, or that exploits or endangers minors;
  • attempt to probe, scan, or test the vulnerability of our systems without our written permission, to bypass any access controls, or to reverse engineer the Service except to the limited extent that mandatory law permits; or
  • resell, sublicense, or share access to the Service except as expressly permitted by your plan or a separate written agreement (such as a white-label Tenant agreement).

You are solely responsible for your conduct and content while using the Service. We may suspend or terminate access that we reasonably believe violates this section or puts the Service, our infrastructure, or other users at risk.

5. Subscriptions, billing, and renewals

Paid plans are billed in advance on a recurring basis (for example monthly or annually) through our payment providers. Card payments for web and direct purchases are processed by Stripe and CloudPayments; in-app purchases on mobile are processed by the Apple App Store and Google Play.

  • Renewals. Unless you cancel before the end of the current term, your subscription renews automatically at the then-current price for that plan. We will charge the payment method on file.
  • Cancellation. You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. We do not provide partial-period refunds except where required by law or this section.
  • In-app purchases. Where you purchase or subscribe through Apple or Google, that store's terms govern the transaction, including its rules for billing, cancellation, and refunds. Those store rules take precedence over this section for in-app purchases, and cancellations or refunds for an in-app purchase must generally be handled through the store, not by us.
  • Metered usage. Some plans meter usage (such as data transferred). Metered charges are calculated from the aggregate transfer counters described in our Privacy Policy — a byte/packet meter, never an activity log.
  • Tenant billing. Tenants are billed for their platform subscription and any usage-based charges under the plan they select in the console. A Tenant is responsible for billing its own end users under its own terms.
  • Taxes. Prices may exclude applicable taxes, which we add where required by law based on your location.

6. Refunds

Except where required by applicable consumer-protection law, or where this section or an applicable app store's policy provides otherwise, fees already paid are non-refundable, and partial billing periods are not refundable on cancellation. Where mandatory law gives you a right to withdraw or a refund (for example a statutory cooling-off period), that right applies and is not limited by these Terms. For purchases made through the Apple App Store or Google Play, refunds are governed and administered by Apple or Google under their respective policies. 7. Trials and promotions

Where a project's billing policy offers a free trial or promotional pricing, the terms shown at sign-up apply. Unless stated otherwise, a trial converts to a paid subscription at the end of the trial period at the then-current price unless you cancel before it ends. Trial availability, length, and eligibility are set per project. We may modify or withdraw promotions at any time, but a change does not affect a subscription already in effect.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing to provide the Service to you would create a security or legal risk; where practicable and lawful we will give notice. On termination, your right to use the Service ends, though sections that by their nature should survive (such as accrued payment obligations, disclaimers, limitations of liability, and governing law) continue to apply.

9. Intellectual property

The Service, including its software, apps, brand, and content, is owned by ForestVPN and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose under these Terms. You retain any rights you hold in content you provide; you grant us the rights necessary to operate the Service.

10. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every threat. A VPN reduces certain network exposure; it is not a guarantee of anonymity or protection against every risk, and you remain responsible for your own conduct online.

11. Limitation of liability

To the maximum extent permitted by law, ForestVPN and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold ForestVPN harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful or infringing use of the Service. This section does not apply to consumers to the extent mandatory law prohibits it.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the version and effective date shown at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of Georgia (the country), without regard to conflict-of-laws principles. The courts located in Batumi, Georgia have jurisdiction over disputes arising out of or relating to these Terms or the Service, except where mandatory consumer-protection law of your country of residence grants you the right to bring proceedings in your local courts or to rely on the protections of your local law. 15. Severability and miscellaneous

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Cookie Policy, and (for Tenants) the Data Processing Agreement, are the entire agreement between you and ForestVPN about the Service.
